The Zoning Board of Appeals is a five member Board, with three alternate members. The Board operates in compliance with the Zoning Board Rules and Regulations and makes its decisions based on the Zoning Bylaws (as authorized under Chapter 40A, Massachusetts General Laws).
The ZBA’s most frequent business involves applications for special permits for home occupations and for accessory apartments. You may view or download a permit application at: application_for_finding.pdf
The Zoning Board of Appeals also administers applications for comprehensive permits for the construction of affordable housing under Massachusetts General Laws Chapter 40B and Town of Pelham 40B Regulations, and it also reviews applications for variances and appeals of decisions by the Building Inspector.
The Board complies with the zoning rules and regulations authorized under Chapter 40A, Massachusetts General Laws, and it makes its decisions based on the Pelham zoning bylaw developed and amended by the Planning Board and voted by Town Meeting.
Changes to the Zoning Bylaw are proposed by the Planning Board and voted by Town Meeting.
Enforcement Authority of the Zoning Bylaw lies with the Zoning Enforcement Officer/Building Inspector.
